These Terms apply to the viewing, downloading, and use of images delivered via this Pixieset gallery.

1. Copyright & Ownership

All images remain the intellectual property of After Hours Photography under Australian Copyright Law.

Downloading images does not transfer ownership.

2. Personal Use License

For private clients (automotive, portrait, or street sessions), you are granted a non-exclusive, non-transferable license to:

• Download and store images
• Share on personal social media accounts
• Tag brands, businesses, or collaborators
• Allow organic reposts by tagged brands or pages, provided credit is given

You may not:

• Sell the images
• Provide them to businesses for advertising or promotional use
• Allow use in paid advertisements or sponsored campaigns
• Submit them for commercial listings (e.g. dealership sales listings)
• Alter, heavily edit, filter, AI-modify, or manipulate the images
• Remove any watermark where applied

Any commercial, advertising, or promotional usage by a third party requires written permission from After Hours Photography.

3. Commercial & Business Use

If you are a business client (detailer, dealership, workshop, brand, publication, etc.), your usage rights are limited to what was agreed in writing or invoiced.

Any extended usage beyond the agreed scope (e.g., paid ads, large-scale campaigns, resale, redistribution) requires written approval and may incur additional licensing fees.

4. Editing & Creative Control

Final image selection and editing style are at the sole discretion of After Hours Photography.

RAW files and unedited images are not provided.

5. Download & File Responsibility

• Galleries may remain active for a limited time.
• Clients are responsible for downloading and securely backing up their images.
• After Hours Photography is not liable for loss of files after delivery.

6. Image Alteration

Images may not be altered, filtered, recoloured, AI-modified, or re-edited without written permission.

Cropping for social media formatting is permitted provided the integrity of the image is maintained.

7. Portfolio & Promotional Use

Unless agreed otherwise in writing prior to the shoot, After Hours Photography reserves the right to use delivered images for:

• Portfolio
• Website
• Social media
• Marketing material
• Publication submissions

If confidentiality is required, this must be agreed in writing before delivery.

8. Liability

After Hours Photography is not responsible for:

• How third parties use images once shared publicly by the client
• Infringement caused by client misuse
• Loss, corruption, or deletion of downloaded files

Maximum liability is limited to the amount paid for the photography service.

9. Acceptance

Downloading images from this gallery constitutes acceptance of these Terms.

10. Commercial Reuse by Third Parties

If a third party (brand, dealership, workshop, publication, etc.) wishes to use any image for commercial or advertising purposes, they must obtain written licensing approval directly from After Hours Photography.

Failure to do so may result in licensing fees being invoiced retroactively.
